1. General
These Terms and Conditions (“Agreement”) govern all work performed by Marine Customs LLC (“Company”) for its clients (“Client”) including, but not limited to, marine decking solutions, installations, and related services. By engaging Marine Customs LLC, you agree to be bound by this Agreement.
2. Scope of Work
The scope of work will be specified in the Project Agreement between the Client and the Company. Any changes to the scope must be mutually agreed upon in writing and may incur additional charges.
3. Payment Terms
a. For custom projects, a deposit of 50% of the total project cost is required to initiate work. b. The remaining balance for custom projects must be paid upon completion. c. All online purchases require payment in full at the time of purchase.
d. All payments must be made in USD via accepted payment methods specified in the invoice.
4. Timeline and Delays
The estimated project completion timeline will be communicated to the Client. The Company shall not be liable for delays due to unforeseen circumstances, including but not limited to weather conditions, supply chain disruptions, or acts of God.
5. Warranty
The Company provides a warranty for its marine decking products and services for a period of three (3) years from the date of completion, covering defects in materials and workmanship. This warranty is void if the products have been improperly maintained or altered by the Client.
6. Limitation of Liability
The Company shall not be liable for any indirect, incidental, or consequential damages arising from the work performed. The Company’s liability shall be limited to the value of the contract.
7. Cancellation and Refunds
a. If the Client cancels the project after the deposit has been paid, the Company reserves the right to retain the deposit.
b. Refunds are not provided for completed services.
8. Intellectual Property
All designs, drawings, and related materials provided by the Company remain the property of the Company unless otherwise agreed upon in writing.
9. Governing Law
This Agreement shall be governed by the laws of the State of Florida.
10. Dispute Resolution
Any disputes arising from this Agreement shall be resolved through mediation in Brevard County, Florida. If mediation fails, the matter will be settled through arbitration as per the rules of the American Arbitration Association.
11. Client Responsibilities
The Client is responsible for ensuring that the site is accessible and prepared for the installation work. Any delays or additional costs resulting from site conditions are the responsibility of the Client.
